Trust. That single word embodies the indispensable requirement between a business and its lawyer. For over 30 years, Philip A. Toomey has earned and kept the trust of both private and public employers and businesses.
Trust has been earned in the trenches. Mr. Toomey is a well-respected litigator in employment and business law matters, including defense of class action wage and hour claims. He has successfully litigated claims involving wrongful termination, disability, race/ethnicity and age discrimination, wrongful inducement, sexual harassment, public policy/whistle-blower claim, workplace violence / safety, workplace privacy, and trade secret / unfair competition, and successfully resolved unionized employee arbitrations. For corporate clients, Mr. Toomey handles EPLI covered claims as pre-approved counsel. He has also supervised outside or assigned attorneys, driving discussions of risk, strategy, planning, cost and impact. When litigation lands, trust has been earned with successful results at a cost that reflects value.
Trust has been earned in the corporate offices. As former regional counsel for one multi-national corporation, Chief Legal Office for another, and outside general counsel for multiple multi-state businesses, he "gets it." Legal matters are resolved within the context of business realities. In the words of one CEO, Mr. Toomey is "a business person who just happens to be a good lawyer." Listening, responsive, transparent and accountable are descriptive words used by clients. He has experience in planning and defending reduction in force initiatives, corporate campaigns and union organization activity. He has investigated and resolved numerous sensitive in-house matters, including corporate ethics, senior level and key employee sexual harassment, theft, misuse of confidential information, and diversion of corporate opportunities. Mr. Toomey has successfully closed several senior level separations, and advised management and boards on successor employer liability, Sarbanes-Oxley, and fiduciary obligations. Having a broad base of experience in business matters and bottom line demands, Mr. Toomey brings to the table a unique and valuable skill set. And as a law firm's managing partner for over 10 years, he has practical experience honed by making the difficult day-to-day decisions.
Trust has been earned in transactional matters. In addition to providing strong human resource support, Mr. Toomey has set up, maintained compliant, dissolved, merged and acquired hundreds of privately held businesses. He has negotiated and documented exit strategies, including leveraged management buy-outs. He has negotiated and reached agreement with a host of Fortune 1000 companies. From the perspective of risk management, he has reviewed hundreds of insurance policies and negotiated coverage disputes. Having a background in litigation lends itself to documents that are thorough and practical, and if challenged, stand up. Most represented businesses have double-digit years as clients.
Since 2005, Mr. Toomey has been ranked in the top 5% of Southern California employment lawyers, is enrolled in the Register of Preeminent Law Firms, and holds the prestigious peer review rating of A-V. He has been trained as a mediator by the Los Angeles Superior Court, currently serves as outside general counsel for two multi-state companies, Two Chefs on A Roll and Prestige Maintenance, and outside labor counsel for one municipal government employer. A graduate of Loyola Law School, Mr. Toomey is a member of the national merit societies Alpha Sigma Nu and St. Thomas Moore. In addition to professional memberships, he is a member of PIHA, SHRM and the CEO organization, Vistage International. Mr. Toomey regularly speaks to business groups and has been published numerous times.
Understanding the needs and objective of a business and delivering measurable value earns trust. For over 30 years, trust has been Mr. Toomey's bottom line.
