Carico Johnson Toomey Establishes New Law Regarding Public Employee Retirement Board Statutory Deadlines

Attorney William G. Benz established new and significant case law in recent Public Employee Retirement Board (PERB) cases. The published decisions set forth new parameters regarding public employee union cases, including premature declaration of impasse. These decisions also established the required deadlines between public employees and union negotiations.

Mr. Benz represented the City of Redondo Beach in both cases and the decisions reached in these cases will now be included in the California Public Employers Labor Relations Association’s training curriculum regarding new challenges and realities with declaring impasse. The success of Mr. Benz’s cases will also be used as the case study in enforcing PERB statutory deadlines.
